If your company was charged “unreasonable” detention and demurrage fees – “unreasonable” meaning you were charged but your goods were unavailable – there may be a remedy that can include refunds for those fees already paid.

The unprecedented amount of detention and demurrage fees being charged and the circumstances in which they are being assessed have made it more financially attractive for affected companies to file complaints with the Federal Maritime Commission. If filed within three years of the statutory violation, a complainant can seek damages. Properly resolved, a complaint may therefore not only halt current problematic practices but also result in reparations for unreasonable detention and demurrage fees already paid.
